ELK RAPIDS — Village officials in Elk Rapids voted to make public parks, beaches and trails off limits to smoking.

On Monday, the Elk Rapids Village Council voted 4-2, with one absence, to approve an ordinance that both defined smoking and identified all the places it won't be allowed. The two trustees who voted against the new local law said they wanted the policy vetted by legal counsel before being implemented.

The newly adopted village law defines smoking of any tobacco product or other plant — such as marijuana, shisha and hookah — whether as cigarettes, cigars, pipes, bongs, vaporizers or electronic cigarettes. Prohibited areas would include all village-owned buildings, plus all parks, beaches, public access sites, fishing piers, trails and pathways, among other places.

Plans calls for self-policing of the ordinance, though violation of the rule can warrant a municipal civil infraction from a police officer by discretion.
