Letter to the Secretary of State concerning Meijer's review of possible campaign finance violations

Dear Director Thomas:

I write on behalf of Meijer, Inc. and Meijer, Inc.'s PAC, Meijer Political Action Committee of Michigan, an independent committee duly registered pursuant to the Michigan Campaign Finance Act, MCL 169.201, et. seq. ("MCFA"), which is authorized to make contributions and expenditures pursuant to that Act.

As the Michigan Department of State is already aware, we were retained by Meijer, Inc. to thoroughly review various activities associated with certain elections that occurred in Acme Township, Michigan. During this investigation we received unfettered access to any and all relevant persons, documents or records. As part of our review, we discovered that certain expenditures that should have been made by the Meijer PAC were in fact made by Meijer, Inc. directly. We also found that necessary reporting of expenditures did not occur. Our review showed what we believe are likely campaign finance violations that occurred in connection with both the Acme Township August 2, 2005 Moratorium Election and the February 27, 2007 Recall Election.

Please advise us of the process and procedure by which we can address and resolve these issues as required by MCFA.

We have all the necessary applicable supporting documentation, which we can provide you upon request, to fully address these matters. Meijer is prepared to accept all fines and penalties you deem applicable and appropriate to remedy any errors, omissions or violations relating to the MCFA.

We are, of course, available to discuss these issues further at your convenience.
