Students caught having sex on tennis courts

— TRAVERSE CITY — A local student is charged with a misdemeanor after officials caught him having sex with a girl on Traverse City Central High School's tennis courts during school hours.

Patrick Miguel Davis-Mercado, 18, and a girl, 15, were caught in the act April 29 about 10:30 a.m., Grand Traverse County Chief Assistant Prosecutor Noelle Moeggenberg said.

Teachers at nearby Eastern Elementary quickly diverted students' attention, and a school liaison officer was notified.

"We haven’t heard of anyone, any kids, who had actually seen anything," Moeggenberg said.

The pair, both high school students, admitted to the act, Moeggenberg said.

The girl's case will be handled through juvenile court. Prosecutors chose not to issue a felony criminal sexual conduct charge against Davis-Mercado because the girl is close to age of consent.

"She was pretty close to 16, which is age of consent. Usually what we do is look at how many years apart they were and make sure there was no alcohol, drugs, force or coercion used," Moeggenberg said.
