1:06pm: Trial for woman in son's death

BELLAIRE — A local woman will stand trial in the death of her son.

Anne Avery-Miller was bound over to 13th Circuit Court after final arguments Tuesday before 86th District Court Judge Thomas J. Phillips. A preliminary examination began last week.

"We believed that we had enough evidence to see the case bound over," Antrim County Prosecutor Charlie Koop said.

Avery-Miller, 39, is charged with an open count of murder in the Nov. 7, 2007, shooting death of her son, Sam Avery, 16. She was indicted last month by a one-man grand jury consisting of 13th Circuit Court Judge Philip E. Rodgers. Authorities used a grand jury because they had trouble with witness cooperation.

She is scheduled to appear Jan. 28 in Circuit Court for arraignment, Koop said.

Avery died of a single gunshot wound to the back of the head. Avery-Miller allegedly told a fellow patient at a mental health facility that she shot her son, according to the indictment.
